As of OEP 2024, CMS has required agents to complete 3 consents when assisting clients with enrolling in an Affordable Care Act (ACA) plan.
#1: ACA CLIENT ACCESS CONSENT:
It gives the client control over who can access their records and for what purpose
To Access: Select CLIENT tab > CLIENT SIGNATURES > ACA CLIENT CONSENT
# 2- ACA CLIENT ELIGIBILITY CONSENT β
Allows an individual to explicitly agree that an agent or broker assisting them with Affordable Care Act (ACA) marketplace enrollment can access their personal information and help them complete an eligibility application, ensuring transparency and confirming the accuracy of the data submitted on their behalf
To Access: Select when reviewing the ACA eligibility app before downloading eligibility notice.
# 3 - ACA CLIENT ENROLLMENT CONSENT:
Ensures that agents only act on the consumer's behalf with their full knowledge and agreement while also protecting the consumer's privacy and upholding compliance standards
